MY LORDS:What have I to say why sentence of death should not be pronounced on me according to law? I have nothing to say that can alter your predetermination, nor that it will become me to say with any view to the mitigation of that sentence which you are here to pronounce, and I must abide by. But I have that to say which interests me more than life, and which you have labored (as was necessarily), your office in the present circumstances of this oppressed country) to destroy. I have much to say why my reputation should be rescued from the load of false accusation and calumny which has been heaped upon it. I do not imagine that, seated where you are, your minds can be so free from impurity as to receive the least impression from what I am going to utterI have no hopes that I can anchor my character in the breast of a court constituted and trammeled as this isI only wish, and it is the utmost I expect, that your lordships may suffer it to float down your memories untainted by the fou l breath of prejudice, until it finds some more hospitable harbor to shelter it from the storm by which it is at present buffeted. 1 Was I only to suffer death after being adjudged guilty by your tribunal, I should bow in silence, and meet the fate that awaits me without a murmur; but the sentence of law which delivers my body to the executioner, will, through the ministry of that law, labor in its own vindication to consign my character to obloquyfor there must be guilt somewhere: whether in the sentence of the court or in the catastrophe, posterity must determine. A man in my situation, my lords, has not only to encounter the difficulties of fortune, and the force of power over minds which it has corrupted or subjugated, but the difficulties of established prejudice: the dies, but his memory lives. That mine may not perish, that it may live in the respect of my countrymen, I seize upon this opportunity to vindicate myself from some of the charges alleged against me. When my spirit shall be wafted to a more friendly port; when my shade shall have joined the bands of those martyred heroes who have shed their bloo d on the scaffold and in the field, in defense of their country and of virtue, this is my hope: I wish that my memory and name may animate those who survive me, while I look down with complacency on the destruction of that perfidious government which upholds its domination by blasphemy of the Most Highwhich displays its power over man as over the beasts of the forestwhich sets man upon his brother, and lifts his hand in the name of God against the throat of his fellow who believes or doubts a little more or a little less than the government standarda government which is steeled to barbarity by the cries of the orphans and the tears of the widows which it has made. 2 I appeal to the immaculate GodI swear by the throne of Heaven, before which I must shortly appearby the blood of the murdered patriots who have gone before methat my conduct has been through all this peril and all my purposes, governed only by the convictions which I have uttered, and by no other view, than that. of their cure, and the emancipation of my country from the super inhuman oppression under which she has so long and too patiently travailed; and that I confidently and assuredly hope that, wild and chimerical as it may appear, there is still union and strength in Ireland to accomplish this noble enterprise. Of this I speak with the confidence of intimate knowledge, and with the consolation that appertains to that confidence. Think not, my lords, I say this for the petty gratification of giving you a transitory uneasiness; a man who never yet raised his voice to assert a lie, will not hazard his character with posterity by asserting a falsehood on a subject so important to h is country, and on an occasion like this. Yes, my lords, a man who does not wish to have his epitaph written until his country is liberated, will not leave a weapon in the power of envy; nor a pretense to impeach the probity which he means to preserve even in the grave to which tyranny consigns him. 3 Again I say, that what I have spoken, was not intended for your lordship, whose situation I commiserate rather than envymy expressions were for my countrymen; if there is a true Irishman present, let my last words cheer him in the hour of his affliction. 4 I have always understood it to be the duty of a judge when a prisoner has been convicted, to pronounce the sentence of the law; I have also understood that judges sometimes think it their duty to hear with patience, and to speak with humanity; to exhort the victim of the laws, and to offer with tender benignity his opinions of the motives by which he was actuated in the crime, of which he had been adjudged guilty: that a judge has thought it his duty so to have done, I have no doubtbut where is the boasted freedom of your institutions, where is the vaunted impartiality, clemency, and mildness of your courts of justice, if an unfortunate prisoner, whom your policy, and not pure justice, is about to deliver into the hands of the executioner, is not suffered to explain his motives sincerely and truly, and to vindicate the principles by which he was actuated? 5 My lords, it may be a part of the system of angry justice, to bow a mans mind by humiliation to the purposed ignominy of the scaffold; but worse to me than the purposed shame, or the scaffolds terrors, would be the shame of such unfounded imputations as have been laid against me in this court: you, my lord [Lord Norbury], are a judge, I am the supposed culprit; I am a man, you are a man also; by a revolution of power, we might change places, tho we never could change characters; if I stand at the bar of this court, and dare not vindicate my character, what a farce is your justice? If I stand at this bar and dare not vindicate my character, how dare you calumniate it? Does the sentence of death which your unhallowed policy inflicts on my body, also condemn my tongue to silence and my reputation to reproach? Your executioner may abridge the period of my existence, but while I exist I shall not forbear to vindicate my character and motives from your aspersions; and as a man to whom fam e is dearer than life, I will make the last use of that life in doing justice to that reputation which is to live after me, and which is the only legacy I can leave to those I honor and love, and for whom I am proud to perish. As men, my lord, we must appear at the great day at one common tribunal, and it will then remain for the searcher of all hearts to show a collective universe who was engaged in the most virtuous actions, or actuated by the purest motivesmy countrys oppressors or I? 6 I am charged with being an emissary of France! An emissary of France! And for what end? It is alleged that I wished to sell the independence of my country! And for what end? Was this the object of my ambition? And is this the mode by which a tribunal of justice reconciles contradictions? No, I am no emissary; and my ambition was to hold a place among the deliverers of my countrynot in power, nor in profit, but in the glory of the achievement! Sell my countrys independence to France! And for what? Was it for a change of masters? No! But for ambition! O my country, was it personal ambition that could influence me? Had it been the soul of my actions, could I not by my education and fortune, by the rank and consideration of my family, have placed myself among the proudest of my oppressors? My country was my idol; to it I sacrificed every selfish, every endearing sentiment; and for it, I now offer up my life. O God! No, my lord; I acted as an Irishman, determined on delivering my country from the yoke of a foreign and unrelenting tyranny, and from the more galling yoke of a domestic faction, which is its joint partner and perpetrator in the parricide, for the ignominy of existing with an exterior of splendor and of conscious depravity. It was the wish of my heart to extricate my country from this doubly riveted despotism. 7 I wished to place her independence beyond the reach of any power on earth; I wished to exalt you to that proud station in the world. 9 I wished to procure for my country the guarantee which Washington procured for America. To procure an aid, which, by its example, would be as important as its valor, disciplined, gallant, pregnant with science and experience; which would perceive the good, and polish the rough points of our character. They would come to us as strangers, and leave us as friends, after sharing in our perils and elevating our destiny. These were my objectsnot to receive new taskmasters, but to expel old tyrants; these were my views, and these only became Irishmen. It was for these ends I sought aid from France; because France, even as an enemy, could not be more implacable than the enemy already in the bosom of my country. 10 Let no man dare, when I am dead, to charge me with dishonor; let no man attaint my memory by believing that I could have engaged in any cause but that of my countrys liberty and independence; or that I could have become the pliant minion of power in the oppression or the miseries of my countrymen. The proclamation of the provisional government speaks for our views; no inference can be tortured from it to countenance barbarity or debasement at home, or subjection, humiliation, or treachery from abroad; I would not have submitted to a foreign oppressor for the same reason that I would resist the foreign and domestic oppressor; in the dignity of freedom I would have fought upon the threshold of my country, and its enemy should enter only by passing over my lifeless corpse. Am I, who lived but for my country, and who have subjected myself to the dangers of the jealous and watchful oppressor, and the bondage of the grave, only to give my countrymen their rights, and my country her indepe ndence, and am I to be loaded with calumny, and not suffered to resent or repel itno, God forbid! 11 If the spirits of the illustrious dead participate in the concerns and cares of those who are dear to them in this transitory lifeoh, ever dear and venerated shade of my departed father, look down with scrutiny upon the conduct of your suffering son; and see if I have even for a moment deviated from those principles of morality and patriotism which it was your care to instill into my youthful mind, and for which I am now to offer up my life! 12 My lords, you are impatient for the sacrificethe blood which you seek is not congealed by the artificial terrors which surround your victim; it circulates warmly and unruffled, through the channels which God created for noble purposes, but which you are bent to destroy, for purposes so grievous, that they cry to heaven. Be yet patient! I have but a few words more to say. I am going to my cold and silent grave: my lamp of life is nearly extinguished: my race is run: the grave opens to receive me, and I sink into its bosom! I have but one request to ask at my departure from this worldit is the charity of its silence! Let no man write my epitaph: for as no man who knows my motives dare now vindicate them, let not prejudice or ignorance asperse them. Let them and me repose in obscurity and peace, and my tomb remain uninscribed, until other times, and other men, can do justice to my character; when my country takes her place among the nations of the earth, then, and not till then, let my epitaph be written. I have done. 1. Which of the following statements about Robert Emmet is best supported by the passage? A. He was a patriot, willing to die for his cause. B. He was a traitor, dishonoring his country. JS MILL ON LIBERTY ASSIGNMENT Essay Example | Topics and Well Written Essays - 1500 words
JS MILL ON LIBERTY ASSIGNMENT - Essay Example That the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others. His own good, either physical or moral, is not sufficient warrant. He cannot rightfully be compelled to do or forbear because it will be better for him to do so, because it will make him happier, because, in the opinions of others, to do so would be wise, or even right.â⬠(Mill, Pg. 18) Suicide is a personal decision that does not physically harm other individuals. Millââ¬â¢s Harm Principle clearly applies to self-defense and strives to protect the individual liberty of each of us. As long as our decisions do not affect anotherââ¬â¢s liberty or life then why must we be harnessed by anotherââ¬â¢s morality? That is the question that an anonymous 80 year old from Ohio is posing as well. This is the question to be addressed in the following paper. The letter written in June of 2003 outlined the thoughts of an 80 year old individual. Through the letter one can easily grasp that they have lived a full life, which their life is complete and they simply wish to spare their children whom they love greatly the pain and suffering of a long drawn out fight against various cancers. The author of this letter says, ââ¬Å"What I donââ¬â¢t understand is why people think it is wrong for someone like me to just call it a day, throw in the towel.â⬠(Anonymous. Pg.1) the principle moral issue with this is the individualââ¬â¢s right to life, and the individualââ¬â¢s right to their own life. Millââ¬â¢s clarifies his principle as affecting adults in the ââ¬Å"maturity of their facultiesâ⬠(Mill, Pg. 19) by his own declaration oneââ¬â¢s personal ââ¬Å"good, either physical or moral, is not sufficient warrantâ⬠(Mill, Pg. 18) to prevent another from taking their own life into their own hands. The argument most often heard is that suicide affects the family, and yet we see that the true d etriment here per the anonymous authors letter is the continuance which would cost additional monies and anguish from watching as one you love slowly and painfully drifts away. Millââ¬â¢s point is that society or state has not the right to impose moral standards on an individual if that individual is not harming another physically. The argument can be made that by making it illegal to take decide when one should die, they are in fact presenting ownership of the individual. The very liberty that is proclaimed of body and soul is than repressed at the point of death if one dies as a result of oneââ¬â¢s own hand. Millââ¬â¢s presents the argument that each individual is the proper guardian of their own health; he states that this includes body, mental and spiritual. ââ¬Å"Mankind is great gainers by suffering each other to live as seems good to them, than by compelling each to live as seems good to the rest.â⬠(Mill, Pg. 24) The anonymous older gentleman outlines this by directly asking why it is someone elseââ¬â¢s prerogative as to when he should end his own life. An individualââ¬â¢s liberty must include the freedom to decide when they die if they so choose. Unfortunately, the argument has been made that society must care for all lives within its grasp, and even more unfortunately, this is not the social argument as much as the state based society argument. They are able to make the case that the physical health and wellbeing is the prerogative of society and the state and cannot be left in the hands of the individual.

History HW Essay Example | Topics and Well Written Essays - 5750 words
History HW - Essay Example Republicans maintained that the leaders must be kept out of their political power after the war. The northerners maintained that the southern states were not to be allowed in the congress until after they had totally removed slavery out of their states. Seeing this Lincoln offered amnesty to all the whites in the south apart from those high rank officials who had stimulated the war. He also came up with a reconstruction plan to entice the southerners from their rebellion. Southern leaders, who had not been given amnesty, rejected the reconstruction laws and replaced it with another bill. This bill was known as the Wade-Davis bill and it was passed in the house after voting it in. however Lincoln refused to sign the bill after it had been passed and this made the two senators mad and prompted them to stop the reconstruction laws. Soon after, Lincoln was assassinated and this led to the rebellion from the south over his death. His successor Johnson passed three important amendments; these included the 13th amendments that abolished slavery, the 14th amendments which allowed every person born and raised in the US to be a US citizen. The 1th amendment allowed every citizen to vote. The other reconstruction that was done is the military reconstruction. In this reconstruction, the southern army was reconstructed and new leaders appointed to serve as army leaders. This was done to remove the old army leaders who had brought the fighting. Taxing reconstruction was also a major change in the reconstruction. In the past property was given value by their owners and they took the taxes themselves to the authorities, however this changed after the reconstruction of the new taxing laws. Most of the southerners were against the reconstruction laws because they felt that these laws were meant to punish them due to their resistance. This made them to oppose the laws and in turn refuse to follow the orders. The upper south soon agreed to end the opposition to the

Comparison between Utilitarianism and Idealism Essay Example for Free
Comparison between Utilitarianism and Idealism Essay The two theories that will be compared and contrasted in this essay are Platos Idealism and Mill Benthams Utilitarianism. I chose these two theories because, to me, they are the ones that seem to be the most realistic and interesting. The way to get from the level of the is to the level of the ought of the Philosophers in these theories are the two bests. In this essay, it will be shown that the two theories are not so different in their relation between the level of the is and the level of the ought; it will be shown that Idealism would be a better theory for a society with highly intellectual people, and that a combination of these theory would be the best way for our society to evolve from the level of the is to the level of the ought. Platos way to go from the is to the ought is socratic questioning. He says that we should question ourselves on whether the moral views we have are ideal or not. He also says that the way of looking at things we have is wrong because all men are not the same, and so they do not have the same opinion of things. Part of his theory says that to get to true virtue (ideal moral views) we have to trim down all the false moral views we have and get to the basic, timeless, and unchanging patterns of the Good. With those ideal moral views we would be able to mirror the Good. Examples of false ideal moral views for Plato are seeking for selfish pleasures such as food, sex, and power. For Utilitarians, the way to get from the level of the is to the level of the ought is to reward or sanction a person for his or her actions. In Utilitarism people should choose actions that are the most utile for them but also for society. In other words they should choose the most pleasant and less painful actions and consequences for the greatest number of people. The degree of utility (degree of pleasure) is determined by what is called felicific calculus. This pleasure calculator is composed of different criterions that caracterise the pleasure provided by a certain action. They are intensity, duration, certainty, proximity, fecundity, and purity. These caracteristics of pleasure are calculated for ones self and for the population that his or her action concerns. If an action is said to have a fairly good utility to one but a very big disutility to society, it is said to be an immoral action. In that sense selfish pleasures are immoral. In these two theories, the socratic questioning and the felicific calculus almost play the same role in the way that the result (chosen action) should be the same if one is calculating the utility or one is referring to socratic questioning to take a decision. The socratic questioning of Idealism brings the person at the door of the right moral views by trimming all the layers of appearances and opinions over a concept. Even if one is not seeking those ideal moral views the felicific calculus should take one to the same ideal moral views if it is well performed. In that sense these two theories are the same because they give the same final result. But one of the theories seems harder to realize because everyone has to go through a long process that not every individual wants to perform or is able to perform. This theory is Idealism. On the other hand, in Utilitarianism a scale can be made out to lead people in the right way (and that scale is in fact present in our society). These theories are different in the sense that Utilirianism is easier for a society to perform well. To give rewards and punishments, society needs an authority outside the person who acts; this is why there are governements, theocracies and social opinions to guide people. Utilirianism is the most realistic because people do not have to think about what is right or wrong, they only have to follow the guides (rewards/sanctions). The society we live in is clearly Utilitarian. The many rewards (salary, respect, etc. ) and sanctions (prison, school failure, etc. ) reveal it. Everything works in function of rewards and sanctions. It implies that we only have to follow the rules given and no sanctions should be given to us. If our society was Idealist, it would imply that we would have to think and do the socratic questioning at each dilemma we have. This is impossible because not everybody is intelligent enough to do so, and most of the people would not be willing to go through that process. There is a danger in having a Utilirianism society. We just have to think of the United-States with the war they made to Irak. I believe that the population of that country trusted the felicific calculus scale (which was written by the governement) too much, because most of the population (of the USA, of course ) believed that war in Irak was a good thing. In that case the scale of that population was wrong because it did not care enough about what Irakians really wanted. If that dilemma had been well calculated, I am sure that they would let Irakians rebuild their country all alone and stop occupying the country. An Idealist society would take the time and think about that situation. They would have come to the conclusion that this war was not fair and they would have wanted to wait for real proofs of the presence of massive destruction arms before bombarding Irak. Another problem that Utilitarianism has raised is the sexual inequality. I believe that the situation we are in is caused by an error in the scale of the felicific calculus. The authority in place decided very long ago that women were inferior, and then nobody really thinked about it (or had the courage to change things) until the first feminists movements. With an Idealistic society that problem would never had occurred because Idealists always ask themselves if what they do is right. They would have understood long ago that this situation is completelly wrong. The best way to go from the level of the is to the level of the ought in our society would be to combine these two theories. First, Idealism should be used by a group of intellectuals to create a scale that would be used in felicific calculus. Then, felicific calculus should be used by the population. The scale from the felicific calculus should be adjusted as time goes on so that it evolves well with the new technological, economical and historical facts. But this is only an utopic idea because nobody would be able to create and maintain a fair felicific calculus scale since nobody can totally get to the basic principles of morality.

It is a despicable practice that is widely acceptable around the nation in fire departments and in business. However, it is not tolerated on the legal front, nor should it ever be condoned in a professional environment. Discrimination on the basis of sexual orientation or gender is absolutely intolerable and is a plague on todayââ¬â¢s fire service. Claims on sexual harassment arise all the time and are never short of horrendous and demeaning acts, as well as crude remarks against the plaintiff. Many legal issues arise when it comes to sexual harassment as so many aspects play into a claim of sexual harassment. The term ââ¬Ësexual harassmentââ¬â¢ is defined as ââ¬â ââ¬Å"Unwelcomed sexual advances, requests for sexual favors, and verbal or physical conduct of a sexual nature, when submission to or rejection of this conduct affects an individualà ¢â¬â¢s employment, unreasonably interferes with an individualââ¬â¢s work performance, or creates an intimidating, hostile or offensive work environmentâ⬠By J. Curtis Varone, Legal Considerations for Fire and emergency services, 2nd edition, page 421.Accordingly sexual harassment claims tend to include almost all the above elements as well as many more elements, be they physical or verbal. It is also broken down into two main categories. The two categories of sexual harassment are ââ¬Ëquid pro quoââ¬â¢ (this for that) and ââ¬Ëhostile work environmentââ¬â¢. Quid Pro Quo sexual harassment ââ¬â ââ¬Å"Occurs when the employeeââ¬â¢s employment opportunities or benefits are granted or denied because of an individualââ¬â¢s submission to sexual advances or requests for sexual favors. â⬠Varone, 421.Such examples of this kind of sexual harassment would include a female firefighter being denied a promotion unless she submitted to a perverse act entirely u nrelated to the typical means of promotion. Often times, such harassment only occurs whereby the supervisor is the harasser, making the employer strictly liable for the claim. Hostile Work Environment sexual harassment ââ¬Å"Occurs when unwelcome sexual conduct unreasonably interferes with an individualââ¬â¢s work performance or has the effect of creating an intimidating or offensive work environmentâ⬠Varone, 422. Such related examples do not even need to relate to employment opportunities or anything related under ââ¬Ëquid pro quoââ¬â¢ harassment. It is possible for hostile work environment harassment to occur when either the employer or supervisor should have known about the event occurring, or that the said supervisor should have done something about it. Possible examples include sexually oriented comments, display of sexually oriented material in the workplace, sexually oriented demeaning names or obscene remarks or jokes to the harassed individual.Often more time s than not, hostile work environment harassment is more common than quid pro quo. Statistics on sexual harassment are surprisingly low compared to other types of harassment or discrimination. Sexual harassment is under-represented due to fear of punishment or disciplinary action. The EEOC puts out statistics every year on the matter. The year of 2011 was the lowest amount of claims year in the past decade; however, the damages done are no less degrading. The below table is based upon EEOC statistics. EEOC Sexual Harassment Claims: 2011 Statistics |Total Claims filed | 11,364| % of Charges Filed by Males | 16. 3%| | Claims Resolutions by Type: | Number | Percent | Settlements | 1,367| 10. 9% | Withdrawals w/Benefits | 1,150| 9. 1% | Administrative Closures | 2,635 | 21. 0%| No Reasonable Cause | 6,658| 53. 0%| Reasonable Cause | 761| 6. 1%| Successful Conciliations | 288| 2. 3%| Unsuccessful Conciliations | 473| 3. 8%| Merit Resolutions | 3,278 | 26. 1%| Total Settlement Dollars | $5 2,300,000| Compared to previous years, 2011 has been substantially lower in amount of claims of sexual harassment. Also seen is the financial burden that sexual harassment carries. It is by no means unreasonable for the amount and extent of damages that occur for the affected individuals. Real examples of sexual harassment in the media are ever prevalent today. One such recent example comes from Phoenix, Arizona. The female plaintiff alleges that she endured years of demeaning names and remarks as well as having been passed up for promotion where it was due. She issued a $70,000 lawsuit against the City of Phoenix. A case very similar to this is the Julia M.Oââ¬â¢Rourke v City of Providence case from the early 90ââ¬â¢s, which I think will be similar to the final outcome of the City of Phoenix case. Julia M. Oââ¬â¢Rourke was one of the first female firefighters in the history of the Providence fire department. She started with 6 other women in the process of the fire departme nts academy in January of 1992. After which, Oââ¬â¢Rourke was hired under the cityââ¬â¢s new affirmative action policy. It wasnââ¬â¢t until this point that the Chief of the department made a sexual harassment policy. The policy stated was to keep sexual related content, be it media, or remarks out of the department. It also stated that the supervisor of each station was responsible to enforce the policy. Also added was a course on sensitivity training as well as a sexual harassment course. Prior to even being fully employed, Julia experienced many instances of sexual harassment during the academy. Almost every instance can be tied to hostile work environment sexual harassment. On numerous occasions, one specific academy member, Ferro, was found to be discussing overly sexual opinions, displaying pornographic content to other members as well as making remarks specifically to Oââ¬â¢Rourke. In one specific event, Ferro pointed to Oââ¬â¢Rourkeââ¬â¢s breasts and claimed t hat she was ââ¬Å"stackedâ⬠, in the company of many other students at a water training exercise. Ferro continued to be a general problem for Oââ¬â¢Rourke during the course of the academy. Even after making through the academy and being hired on at engine 5, B shift, the harassment did not stop, in fact, it got worse. Instead of just from a co-worker, harassment was now coming from the company officer on her shift. A specific event occurred where the company officer threw pieces of paper with Oââ¬â¢Rourkes number out of the engine while going past a bar in the own. Despite being asked to stop by Oââ¬â¢Rourke, the company officer continued and laughed. Also at one point, she was warned that there was the possibility of there being a closed circuit camera in her bunk room. She felt completely invaded and violated in a place that should feel at the very least safe. Volatile treatment like this continued to occur for the next 2 years. Finally in September of 1994, Oââ¬â ¢Rourke sought out the Cityââ¬â¢s EEO officer. This finally got the ball rolling to straighten out and shed justice on the issue.Final verdicts won for Oââ¬â¢Rourke throughout the year of 1997 on numerous cases on the basis of hostile work environment sexual harassment. Oââ¬â¢Rourke was victorious in receiving her dues on the basis of sexual harassment. I feel that the Phoenix Arizona case will play out similarly, but only time will tell as there is not much information so far on the exact events or court trials. Ultimately, sexual harassment will continue to plague the fire service until people become more tolerable of others differences.Sexual harassment is immensely degrading for the affected individual and is nothing short of driving a person to inadequacy. It should never be tolerated in the workplace or professional environment and certainly has no place in the fire service. The main virtue is that a person can do the job. That is the only merit that holds true, but d iscrimination on the basis of gender or sexual preference simply isnââ¬â¢t a proper means of deciding whether or not an individual should be able to perform in this job.It is my hope that there will continue to be a downward trend in sexual harassment claims and actual occurrences as the practice of such is horrendous. She also said that she was considering taking action against Richard if his actions continued.Steve told her he was totally unaware of the problem but agreed something should be done. He asked her to investigate what the organization needed to do to stop this from occurring now and also to anyone else in the future. He also thanked Paula for her patience and honesty and also promised her that something would be done. What Are the Ethical Issues? 1. What is sexual harassment, and why is it prohibited? 2.
